Rates
Villa rental rates quoted on samuiholidayvilla.com,
samuiholidayvilla.co.uk or any of its affiliated sites are in British
pounds and are quoted on a daily or weekly rate, unless otherwise
specified.
Rates quoted allow for
maximum occupancy of 4 persons if renting the 2-bed villa or 6 persons if
renting the 2-bed villa and 1-bed apartment. Only those persons specified
on the booking form may reside at the property as guests. Please notify us
as soon as possible of any changes. The cost of electricity, water,
cleaning and gardening supplies, local taxes are included in the rental
rates, unless otherwise specified.
Additional charges
All additional charges agreed upon must be settled before departure.
Rates do not include airport transfer, baggage handling, gratuities,
telephone, car rental, satellite TV, food, soft drinks and/or liquor, any personal items
and expenses, laundry and any excessive/deep cleaning required upon
departure (such as upholstery shampooing, etc).
Linen and towels are included in the villa.
Payment
Currency: All rental rates are in British pounds, however, in case of
payment made locally, the Thailand regulations require that all charges
are made in Thai Baht converted at the rate of exchange applied by Bank of
Thailand on the day of the debit. Many banks that exchange currency are
located within a short distance of the villa.
Initial Deposit
An initial non-refundable deposit of 40% must be received before a
confirmation can be issued. No confirmation will be issued until funds
have been received and accepted. If funds are not received within 7
banking days the reservation shall be deemed to have been cancelled.
Credit/debit cards cannot be accepted.
Balance Payment
Final payment of the remaining balance must be paid 8 weeks prior to
arrival. Should payment be due to be paid on site upon arrival Travellers
Cheques, credit card withdrawals or cash exchange transactions can easily
be accomplished at any Currency Exchange Counter at Bangkok Airport when
you arrive (they have the most favourable exchange rates) or locally.
Failure to make the final payment on this basis will make reservation
subject to automatic cancellation.
If the booking is made within 8 weeks of the arrival date, 100% of the
cost of the Villa rental shall be due at the time of booking, unless
otherwise specified.
Credit/debit cards cannot
be accepted.
Arrival & Departure Times
Check-in time is after 2:00pm, and checkout time is prior to 11am,
unless otherwise agreed to in writing. Guests are responsible to inform of
your flight arrival/departure times if airport transfer is requested.
Changes by you
Should you wish to make any changes to your confirmed booking, you must
notify us by email as soon as possible. Whilst we will endeavour to
assist, we cannot guarantee we will be able to meet any such requests.
Where we can, an amendment fee may be payable together with any costs
incurred by ourselves.
Cancellation of reservation
If it becomes necessary to cancel all or any part of the booking, we must
be notified in writing or via email. The cancellation will take effect
from the day the written confirmation or email is received. If the
cancellation is made prior to 8 weeks before departure, the cancellation
charge will be the full deposit paid.
If the cancellation is made after 8 weeks before departure and the full
balance has been made, the cancellation charge will be the full charge of
the rental.
Depending on the reason for the cancellation, you may be able to reclaim
the above cancellation charges under the terms of any insurance policy you
may have. Claims must be made directly to the insurance company concerned.
The above cancellation charges also apply if Samuiholidayvilla cancels the
booking due to non-payment of the balance. If the dates of the booking
require to be changed or amended, this may be treated as a cancellation of
the original booking and cancellation charges may apply.
Any change to the original reservation is subject to the approval of
Samuiholidayvilla management.
Alteration and cancellation by Samuiholidayvilla
Though it is unlikely that Samuiholidayvilla will have to make any changes
to confirmed arrangements, it does occasionally happen, and we will advise
you at the earliest possible date.
If the properties are damaged or rendered unusable or for any reason
beyond our control or due to unexpected circumstances we are unable to
provide you with the Villa, Samuiholidayvilla or any of its affiliated
sites or the villas owners/management shall reserve the right to cancel
the reservation.
However, should guests agree, Samuiholidayvilla will endeavour to locate an
alternative property for the period required. If this is not possible, or
you do not wish to be transferred, the villas owners/management will
cancel the booking and refund you in full.
Samuiholidayvilla or any of its affiliated sites shall not be liable for
any further obligations or claims by the client.
Registered guests
The number of people staying at the property must not exceed the maximum
capacity indicated by you in the Samuiholidayvilla or any of its
affiliated sites booking form, except in the case of infants (under two
years old), or unless specifically agreed with the villa owner(s) or
management company. Should the owner or a management company
representative find that the number of people staying at the property
exceeds that on the booking form, additional guests will be subject to a
per person, per day surcharge or may be asked to vacate.
Sorry, no pets are allowed.
Security deposit
A security deposit of £500 (cash only) is required with the payment of the balance.
This is to cover the cost of any damage or breakages during the rental
period of the Villa or their contents. This amount will be returned to you
at the time of departure, less any such costs.
Insurance
As deposits and rental payments may not be refundable after a reservation
has been confirmed, you should consider travel insurance to cover the loss
of money paid to the villa in case of cancellation of your journey.
Samuiholidayvilla or any of its affiliated sites or the villas owners or
management company are not responsible and are held harmless by you and
your party against any and all claims including any accidents related to
the use of the Villa facilities or locally procured third party services
such as, but not limited to, watercraft, water sports, jeep or motorbike
rental.
Samuiholidayvilla or any of its affiliated sites or the villas owners or
management company shall not be responsible for any delay, additional
expense or inconvenience caused directly or indirectly by events outside
Samuiholidayvilla or any of its affiliated sites or the villas owner(s) or
management company 's control such as civil disturbances, fires, floods,
severe weather, power outages, acts of God, acts of Government etc.
By acceptance of this contract it is assumed by Samuiholidayvilla or any
of its affiliated sites or the villas owner(s) or management company that
this requirement has and will be complied with in full.
Liability release
Under no circumstances shall Samuiholidayvilla manaement or owners or any
of its affiliated sites be responsible for any loss, expense, damage,
claim or injury either directly or indirectly, consequential or otherwise
whatsoever, however caused or incurred, whether arising in contract or
otherwise in law or equity as a result of rendering of the services or
accommodation as described or substituted, or by reason of military
action, revolution or acts of God, or by any agents, employees,
subcontractors, servants or third parties whatsoever supplying any of the
services or accommodation herein or as substituted.
If any accommodation and/or services are substituted, Samuiholidayvilla or
any of its affiliated sites will act at all times in good faith and use
its best efforts to substitute with accommodations and/or services of a
type comparable to or better than those originally contracted.
Samuiholidayvilla or any of its affiliated sites, at its sole and
unfettered discretion, reserves the right to refuse or discontinue service
to any person(s) and/or to rescind any contract for accommodations or
guest services.
Complaints
Samuiholidayvilla or any of its affiliated sites accepts no responsibility
for the following:
any modifications made to the villa that are not mentioned on the webpage
or anywhere else
the breakdown of the supply of water, or electricity, or swimming pool
filtration systems
However, shall you contact us during such problem, we will use our best
endeavours to arrange for any such problems to be solved quickly. The
Villa Manager must be notified of any complaints within 24 hours of the
occurrence giving rise to the complaint.
Should a problem remain unsolved please make a complaint in writing to the
villas owner(s) or management company within 14 days of the completion of
the rental period. If the Villa is vacated before the end of the rental
period without mutual agreement this may result in the loss of all rights
to compensation.
No claim can be done after the villa has been vacated without having made
a notification at the time of the problem occurrence to the villas owner(s)
or the management company.
No picture nor video are applicable for claim if neither a representative
of the villas owner(s) or the management company are present at the time
the pictures or the video are taken.
Conduct & behaviour
The person paying the deposit amount for the villa rental is responsible
for the correct and appropriate behaviour of the guests staying at the
Villa. Should any member of the party not behave in such a manner, the
villas owner(s) or the management company may at their absolute discretion
ask the offending guest or guests to vacate the Villa forthwith.
Valuables
It is strongly recommended that safes are used to store items such as
passports, cash, traveller's cheques etc.
Any valuables left at the property are the guests sole responsibility.
Neither the owners nor the staff can be hold responsible for any loss or
damage of personal property.
Due care of the facilities
As part of this agreement and as all villas are privately owned, Guests
are required to take due care when residing at the villas and especially
children playing in the garden, near or in the entrance, the road, the
plunge pool, the beach including the sea.
Handling of furniture, crockery and other artefact shall be done with the
maximum care. The villa staff is there to help if necessary.
Guests are reminded not to enter the Villa wet or to run around the plunge
pool as the floors can be slippery. Damage or injury arising shall not be
the responsibility of the villas owners/management in any way whatsoever.
Children must be supervised when using the pool or playing on the terrace
areas.
Applicable law
These conditions and any contract to which they apply are governed in all
respects by the laws of Thailand and the Thai courts only shall have
jurisdiction in relation to any claim or dispute arising out of, or
connected with them.
AGREEMENT
I / We agree to the above conditions and do hereby agree to the
application of the above Terms and Conditions to our reservation.
